What is the new legislation?

The Amendment to the Building Regulations 2018 incorporating new Pool and Spa regulations has been released. The amended regulations have come into effect on 1st December 2019 and the introduction is widely affecting many property owners and occupiers.

The proposed implementation period requires owners of existing swimming pools and spas to take action by 1st November 2020.

Owners of all swimming pools and spas are required to be registered with your local council prior to or by 1st November 2020.

Then an inspection is required to be conducted and a certification issued by a Registered Building Surveyor or Registered Pool inspector under the following timelines:

For pools and spas constructed 30th June 1994 or earlier: Inspected and certified on or before 1st November 2021
For pools and spas constructed between 1st July 1994 and 1st May 2010: Inspected and certified on or before 1st November 2022.
For pools and spas constructed between 1st May 2010 to 31st October 2020: Inspected and certified on or before 1st November 2023.

The only reason that the legislation was brought in was to improve the safety & security around spas and pools. Compliance checks will help to safeguard against major accidents & drownings at your property.

Do I even need a barrier?

If you have one of these, then yes!

All swimming pools and spas containing water greater than 300 mm (30 cm) must have a compliant safety barrier to restrict access to the pool area by young children. In-ground pools and spas, above-ground pools and spas, including inflatable pools, holding more than 300 mm (30 cm) of water, indoor pools and spas, bathing and wading pools containing more than 300 mm (30 cm) of water.

If you’ve got one of these, then no.

Bird baths, fountains, water supply/storage tanks, fish ponds, dams, baths used for personal hygiene and emptied after each use, spas inside a building (e.g. in a bathroom) used for personal hygiene and emptied after each use, pools or spas that cannot contain a water depth of more than 300 mm, inflatable swimming pools (typically toddler or wading pools) that cannot contain a water depth greater than 300 mm.

Council or Shire spa & swimming pool register & certificate of compliance

Owners need to register their swimming pool or spa with the Council via the applicable council's website or in person. From there properties with a swimming pool or spa have a legal obligation to ensure pools or spas are regularly inspected to comply with safety regulations
